The real party in interest is the defendant in the trial court action, charged with a second violation of A.R.S. § 28-692(B) under § 28-692.01(E). He was found guilty by a jury in the justice court, and he appealed his conviction to the Greenlee County Superior Court. Due to an inadequate record in the justice court, the superior court ordered that the appeal be heard as a trial de novo. The defendant then filed a motion in limine to settle the jury instruction defining "actual physical control" as it appears in A.R.S. § 28-692. The court considered the motion on stipulated facts. We assume jurisdiction of the states petition for special action challenging the courts ruling and grant relief.
